Out-of-Court Dispute Resolution:
a) Pursuant to the Federal Lawyers’ Act (BRAO)
In the event of disputes between attorneys and their clients, out-of-court dispute resolution is available upon request through the Regional Bar Association in Karlsruhe (pursuant to § 73(2)(3) in conjunction with § 73 BRAO) or through the Bar Association’s Mediation Board (Section 191f BRAO) at the German Federal Bar Association, which can be found online via the German Federal Bar Association’s website (www.brak.de), email: schlichtungsstelle[at]brak.de.
b) Pursuant to the VSBG
Pursuant to Sections 36 and 37 of the Consumer Dispute Resolution Act (VSBG), Dr. Martin Duncker is obligated to inform clients who are consumers within the meaning of Section 13 of the German Civil Code (BGB) of the possibility that, in the event of unresolved financial disputes arising from the attorney-client relationship, a consumer arbitration board may also be contacted free of charge. The competent consumer arbitration board for this purpose is the Arbitration Board of the Bar Association, Rauchstraße 26, 10787 Berlin (www.schlichtungsstelle-der-rechtsanwaltschaft.de). In this context, however, it is noted that Dr. Martin Duncker is neither willing nor obligated to participate in proceedings before this body and that Dr. Martin Duncker will refuse to participate in arbitration proceedings before this body.

Under professional regulations, attorneys are prohibited from representing conflicting interests (Section 43a(4) of the Federal Lawyers’ Act). Before accepting a case, we therefore assess whether a conflict of interest exists.
